General conditions of sale triathlonstore.fr and bicyclestore.fr
1. Scope of application
These general terms and conditions of sale (hereinafter the "GTC") apply to all sales of products made on the sites triathlonstore.fr and bicyclestore.fr (hereinafter the "Sites") by SARL Aguisa Sport with capital of €450,000, a company registered in France with the RCS of Pontoise under number 509 298 642, whose head office is located at 27 rue de Grisy, 95830 Cormeilles en Vexin. (hereinafter "the Seller").
2. Products
The products offered for sale on the Sites are those appearing on the pages of the Sites at the time of the order, within the limit of available stocks. The photographs and descriptions of the products are not contractual.
3. Price
Product prices are indicated in euros, all taxes included (TTC). The Seller reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in effect at the time the order is validated.
4. Order
Any order placed on the Sites constitutes acceptance of these General Terms and Conditions. The ordering process includes the following steps:
- Selecting products and adding to cart
- Validation of the basket and choice of delivery method
- Acceptance of the T&Cs
- Payment of the order
The order is considered final after validation of the payment and receipt of the order confirmation by email.
5. Payment Payment for orders is made online by credit card, Paypal or Alma by the Sites.
6. Delivery The products are delivered to the address indicated by the Customer when ordering,
information on deliveries . The maximum delivery time for products ordered on the sites is 10 working days. It includes the time to prepare the Order as well as the time for shipping and Delivery by the carrier. In the event of a delay in delivery, the Customer has the option of canceling his order under the conditions provided for by law,
return policy .
6.1 Loss of package In the event of loss of the package, we will conduct an investigation with the carrier in order to find it. If the order is found, it is immediately reshipped to the Customer. If the order is not found, we will then reimburse the Customer within 14 days following the day of information of the loss of the package.
7. Right of withdrawal In accordance with current legislation, the Customer has a period of 14 days from receipt of the products to exercise his right of withdrawal, without having to provide reasons or pay penalties, with the exception of the return costs which remain his responsibility. The Customer's reimbursement will include the full amount paid by him for the purchase of the product (purchase price including tax, product delivery costs), not including the product return costs which will remain his responsibility. The returned product must be in new condition, complete, with its original packaging, accompanied by all its labels, accessories, documentation and instructions for use, as well as the return slip created from his customer area.
Products returned incomplete, worn, washed, damaged, soiled or damaged by the Customer will not be accepted. 8. Warranty In application of the legislative and regulatory provisions, all orders are subject to the legal guarantee of conformity of article L 217-4 and following of the Consumer Code and the guarantee of hidden defects of the Civil Code, provided for in articles 1641 and following.
9. Liability The Seller cannot be held responsible for direct or indirect damage caused by the use of the products sold on the Sites.
10. Personal data The Sites undertake to respect the privacy of the Customer, as well as the security and confidentiality of the data and information communicated to it by the Customer. As part of the collection and processing of personal data, we provide the Customer with all the information relating to the conditions of
processing of this data and the rights available to the Customer in this section.
11. Applicable law and competent jurisdiction These General Terms and Conditions are governed by French law. Any dispute relating to their interpretation or execution will be subject to the exclusive jurisdiction of the courts of Pontoise.
